The Case
Case Overview
A simple overview for visitors who are new to the case.
Before Trial
Following his arrest, the court set Nick’s bail at $1,000,000 cash. Because he was unable to post that amount, he remained in the St. Croix County Jail while awaiting trial.
- Nick spent approximately 22 months in custody before trial.
- He had no outdoor space or fresh air.
- He had no in-person contact visits with family or friends.
Conviction and Sentencing
In April 2024, a jury found Nick guilty. In July 2024, he was sentenced to 20 years in prison, followed by 6 years of extended supervision.
During sentencing, the judge stated that Nick did not pose a danger to the public, but that he had to be held accountable for the harm caused by his actions.
Why the Appeal?
This has always been a self-defense case. Nick’s position is that he was searching for a lost cell phone when the situation escalated. Within approximately 3.7 seconds, he was struck in the head four times and believed he was in imminent danger of death or great bodily harm.
He chose to defend himself. The appeal asks the courts to determine whether legal errors affected the fairness of his trial and conviction.

Where Nicolae Miu’s Case Stands
Nick has appeal counsel. The case is at the stage where the postconviction motion is being prepared and will be filed shortly.
How Postconviction Relief Works
In Wisconsin, many claims must first be presented through a postconviction motion in the original trial court before the case proceeds to the Wisconsin Court of Appeals.
That means the case initially returns to the same circuit court where the conviction occurred. The court reviews the legal claims and decides whether relief should be granted before further appellate review.
Appeal Counsel
Nick is represented by private appellate counsel. After more than $100,000 was spent defending the case through trial, his personal financial resources were exhausted.
Since then, family, friends, and supporters have helped carry the appeal forward by supporting legal work, investigation, and independent review.
